No contract and wants to have immediate resignation

Hi po

Papatulong po sana ako, i just need advice, i want to hand over an immediate resignation, napakasama kasi ng company na pinasukan ko. I am the MIS head of the company, im earning P500 a day, pero wala po kami SSS/ Philhealth, wala din E-COLA and sickleave and vacation leave. Also they let me handle cashier and other things not related to my job. Pero wala po ako pinirmahan contract sa kanila. I've been here for 1yr and 5months, now i wanted to leave the company and pass an immediate resignation. I can only offer them about a day or two for the transition. Need ko po ba talaga mag render ng 30 days service for the transition.? Coz i really wanted to leave this company asap.

See if you can find a reason below so you do not need to render 30 days. If none of them is applicable, then you are required to comply.

An employee may put an end to the relationship without serving any notice on the employer for any of the following just causes:

1. Serious insult by the employer or his representative on the honor and person of the employee;
2. Inhuman and unbearable treatment accorded the employee by the employer or his representative;

3. Commission of a crime or offense by the employer or his representative against the person of the employee or any of the immediate members of his family; and

4. Other causes analogous to any of the foregoing.

basta make sure po na ang resignation letter mo includes your frustration and disappointments sa management mo. So kapag nag labor case ka ng constructive dismissal magagamit mo na evidences. Make sure you acquire all the evidences like emails or texts na meron ka sa management mo at specific tao sa company mo.
