Ang question ko lang legal ba ung ginawa ng company na isang bagsakan lang nila binigay ung DES ko considering starting date is October 2013 pa?
Tsaka naka 3 na akong appraisal at parati sinasabi sa akin ng chef ko pagdating sa tardiness and absence ung HR bahala dun pero kahit isa walang dumating sa akin na DES.
Tapos everytime na pupunta ang payroll sa amin nakakapagtally naman sya ng mga absence, night def, tardiness and OT pero hindi nya din kinacaught ung attention ng chef ko about it.
I know that this habitual tardiness is ground of negligence of duty under labor code and is a just cause for termination.
But the mere fact that nobody Is giving me a warning or itong DES ngayon lang naibigay sa akin ng isang Bagsakan, may laban ba ako if they are going to suspend or terminate me?
And I would also like to add na I am already recommended for promotion.
