does our HRD have the right to freeze our salary, just because my officemate got a writ of execution from the court?

Isnt it an exemption according to the Rules of court?

Kindly enlighten us regarding this.

Our jurisprudence in Labor Law exempts wages of rank and file employees from garnishment except if upon applying for the loan, the employee authorized the creditor to deduct payment from his wage.

Nota Bene: the prohibition only applies to rank and file employees.

As far as I know there is no cuthorization from the person given to the company to deduct the salary.

Can you please advise us how to go about it? How can we explain it to our HRD/Legal Dept [one and the same] that they don't have authority to freeze the salary of our rank and file employee?

Why is it only applicable to rank and file employees? What about the managers and supervisors? Are they not covered by this law?

would it be wise, or will it be of any help in the future if i will file an affidavit (if that is what it is termed) for the following reason: Yesterday at past 9:00am but not after 9:15am -- which is our break time, my boss chanced on me surfing on the internet re: typhoon Juan. He berated me & accused me of "Nagsasayang ng oras ng trabaho" I would say that it was VERBAL ABUSE because he was on the top of his voice & asked me what have i done for the day. I have just submitted finished drawings to our operations manager. after so many tirades he left the office & banged the door. TALAGANG NAGDABOG. He called two of those who witnessed to his office at sinabihan sila na "hindi intended sa kanila ang mga pasaring na pagsasayang ng oras ng opisina-- would that mean na SA AKIN LANG NAG-AAPLY ANG RULE? Furthermore, may ebidensya po sa cctv na after office hours may empleyado ng kompanya na NAGNANAKAW NG BAKAL-- wala po sila (mngt) aksyon man lang ukol doon--- That is why i would like to have it in writing (legal) para kung sakali man ay may panghahawakan ako... i would ask my officemates to sign on as witness.
