hihingi po ng advice sa mga nakakaalam....
assistant/secretary po ako ng isang chinese employer. nagbusiness po sya ng food kiosk. 5 po ang crew namin. wala pa pong two months nag-ooperate yung business gusto na pong ipasara yung food kiosk kasi hindi kumikita, mahinang-mahina ang benta. ang first step po ng boss ko magbawas ng tao. pinag-iisipan pa po nya kung itutuloy pa nya ang business o tuluyan na nyang ipapasara. ang tanong ko po ano-ano po ba ang dapat ibayad sa matatanggal na empleyado? at pag tuluyan na pong nagsara ang business, may difference po ba sa marereceive ang mga empleyado sa kadahilanang bankruptcy?

2 months ka pa lang.. malabong may matanggap kayo.. sabi mo pa lugi ang business.. i suggest maghanap ka na lang nang ibang trabaho..

Thanks po sa reply.
As the secretary of the employer, mareretain po ang work ko. Yung mga crew po ang mawawalan ng trabaho. Sinasabi po kasi nila na dapat may matanggap silang 13th month pay dahil lumagpas sila sa one month. May pagkakuripot kasi ang boss ko at dahil chinese at bago pa lang nagnenegosyo dito sa Pilipinas hindi sya aware sa 13th month pay. Pwede bang idahilan ng boss ko na lugi ang business kaya hindi sya magbibigay ng 13th month pay sa male-layoff na crew?

Pag nalulugi at magsasara o magbabawas ng tao, may responsibilidad pa rin ang may ari na magbayad ng:

1. sweldo
2. separation benefit (1/2 month sweldo for every year ng trabaho)
3. pro-rated 13th month pay
4. tax refund (adjustment)

Separation benefit - only if there is a company benefit, or if tatanggalin ang tao dahil nalulugi o sobra ang tao.

13th month - required, pro-rated, basta naka isang buwan.

Assuming a company that is about to close, which computation applies?


In case of termination due to the installation of labor-saving devices or redundancy, the worker affected thereby shall be entitled to a separation pay equivalent to at least his one (1) month pay or to at least one (1) month pay for every year of service, whichever is higher.


In case of retrenchment to prevent losses and in cases of closures or cessation of operations of establishment or undertaking not due to serious business losses or financial reverses, the separation pay shall be equivalent to one (1) month pay or at least one-half (1/2) month pay for every year of service, whichever is higher.
