How to file a complaint in the Regional Trial Courts?

Arresto Menor

We are intending to file a complaint against the Eton Group for their delay in completion of Eton Tower Makati by two years from 31st December 2013 to 31st December 2015.  We will be claiming for compensation for the two years delay.  Any idea or formula for compensation for such a case?  

Can you advise if we should file a complaint at the HLURB or Regional Trial Courts?  What are the benefits?  

How do we go about filing a complaint at the Regional Trial Courts?  We can’t find the website for the Regional Trial Court.  Can someone provide us with the website so we can look further into it?  

We’re Singaporeans, so we are wondering if we can just send the necessary documents to them by registered post and have the case proceed by evidence without us having to attend the hearing.    

Would appreciate your earliest reply to our questions.  Thanks!

You may need to retain the services of a lawyer to handle any case for you.

Since the Eton group is headquartered in Makati City, then you may need to file with the city courts.

File a complaint first at the office of HLURB. They are the agency assigned by law to handle the complaint of every buyers against the developers. They are also the authorized office to penalize the developer in case proven that they have violated the rules and regulations set forth by them. The Regional Trial Court will not accept your complaint without the recommendation of HLURB. I suggest you to check first the documents in relation with the project because the developer is allowed to file for an extension of time to develop/complete the project.

You can give your Pinoy Attorney SPA ( SPECIAL POWER OF ATTORNEY ) then he appears in Court for you.. YOU DO NOT BE PRESENT IN THE COURT HEARINGS...

you can file both in rtc and in hlurb.

you may file in makati court a civil case of breach of contract. no need to come to philippines. just get a lawyer and execute a special power of attorney.

you may file also in hlurb to sanction the company for the delay and/or breach of their obligation. assuming hlurb has jurisdiction over the project.
