eto po yung problem kokumuha po kami ng bahay sa imus, cavite. homemark inc. po yung pangalan ng developer. nakaka 3 months pa lang po kami ng hulog sa downpayment. eh 5 months to pay po yun. nagkaproblema na po kami sa financial problem. ngayon po balak nin kunin yung perang ibinayad namin pati yung pinang reservation namin. eh sabi po nung developer at agent, di na daw po namin makukuha lahat ng ibinayad namin. ano po bang pwede naming gawin? di naman biro yung hinulog namin dun. kailangan namin yung pera. di na kc namin itutuloy yung pagkuha ng bahay dun. advice naman po. thanks.

ano ang sabi ng kontrata tungkol sa pag-refund?

Section 3 of Maceda Law indicates that the buyer has a right to a refund and grace periods as long as the buyer has paid at least two years.

However, if there’s still less than 2 years of installment payments made, the buyer is only entitled to 60 days grace period as indicated in Section 4.

wala pa pong 2 years yung installment na binabayad namin sa downpayment nun. 5 months pa lang po yun. so pano po gagawin naming hakbang? financial problem kase kya gusto naming irefund na lang yung pera. thanks po.

Sorry, you have to refer back to the contract if they allow any refund.

If none, then that's the end of it.

ay ganun po ba yun. sayang lang pala lahat ng hinulog namen sa downpayment. :'( may paggamitan pa naman kami ng pera.
