i was married to a japanese guy 2003 in the phil. and went to japan,2008 we filed a divorce in japan with no child.2010 nagkabalikan kmi kya d n kmi ng file ng finality of divorce s phil.,until now nagssma prin kmi ng hindi kasal d2 s japan at wala prin kming anak.hanggang s nlman ko lately n nagkaroon pla ang asawa ko ng affair s ibang filipina habang kasal p kmi d2 s japan,binigyan ng asawa ko ng acknowledgement yung babae pra s naging anak nila,Now the the girl is harrassing me by mail and facebook.Posting they're old pictures and mail before publicly.Anu po kya ang pwede ko ikaso dun s babae since d2 n po ako nka base s japan,At nsa pilipinas yung babae!?divorce man kmi d2 s japan pero dahil walang finality s pilipinas may karapatan prin po b ko n mtwag n asawa!? Kung sakaling pede ko cya idemanda how much will it costs po!???maraming slamat po.god bless you all

good morning. legally, you are still married here in the Philippines. kasi, our local laws do not acknowledge divorce, my karapatan parin kayo na tawagin na asawa. as far as japan law is concern, divorce po kayo dun so hindi kayo married na dun. hence, if the crime of concubinage was committed by your husband in japan, you do not have a cause of action against him in the philippines. if the concubinage was committed while your were still married, you do not have a cause of action to file here in the philippines since, the crime is committed abroad. wala tayong jurisdiction over the crime.

Technically, Any foreign spouse, if and when they divorce you in their country, your marriage is no longer valid, it can only applies to you, but no longer applies to him. Because in his country he already divorced you, all he needs to do is file the divorce papers in the Philippines for acknowledgement.

If any Filipino divorced their foreign spouse, then it will not be acknowledgeable in the Philippines as Philippines is the only country that does not have divorce.

In other words, foreign spouse divorce counts but Filipino divorce does not count.

Before I could give you a piece of advice, I have questions first:

1. When you said "we filed," does it mean you both filed for divorce? If not, who initiated the divorce proceeding?

2. We're you already a Japanese citizen when you filed for divorce? This is assuming that both of you initiated the divorce proceeding.

3. Are you a Japanese citizen now?

I am Currently working abroad for 1 year and 4 months. Married for 6 years and we have 2 children ages 7 and 5. my husband worked in taiwan for 6 years from 2011 and stayed for good last August 2017, he had other woman in taiwan for almost 4 years now who stayed for good as well in PH. Later on i found out that my husband brought his woman from Negros to close to the place where my/our family lives and the most hateful part was he introduced my kids to her not as a lover but as friend. I TALKED to my husband who is my ex now, told me to "MANAHIMIK" ka nlng muna," . I want to file a case but how. Sad part is i cant do anything here.
