Hi everyone.

I need a legal advice regarding the application of maternity leave in a manufacturing Company here in the Philippines. My cousin is a regular employee and she is pregnant and want to avail her Mat leave sooner coz this was her first time. Her due date was June 15.

1) According to the constitution what will be the exact date to avail
her leave?

2) She can avail it sooner or 1week advance?

3) Her HR Rep. said she will not avail her 6weeks salary during her leave, it that legal?

4) Her Mat1 was filed in her company February, she can get it only this month. What will be the right computation for it?

Hi,

here are my answers on your question based on my experience.

1) According to the constitution what will be the exact date to avail
her leave? - she can avail her maternity from the exact date of the delivery date or earlier if needed  (as per advice by her OBGYNE).


2) She can avail it sooner or 1week advance? - she can avail her maternity leave earlier. she can ask her OBGYNE for a medical certificate.

3) Her HR Rep. said she will not avail her 6weeks salary during her leave, it that legal? - That is correct. The company will not pay her during her leave but it will be SSS who will pay her. That is what SSS Maternity Benefit is for. but dont expect that she will get her whole salary. it is still depending on her contributions.

4) Her Mat1 was filed in her company February, she can get it only this month. What will be the right computation for it? - SSS will pay her before the delivery date and after the delivery date considering she has provided all the nessessary documents. The amount she will get depends on her contribution.
