I need a legal advice regarding the application of maternity leave in a manufacturing Company here in the Philippines. My cousin is a regular employee and she is pregnant and want to avail her Mat leave sooner coz this was her first time. Her due date was June 15.
1) According to the constitution what will be the exact date to avail
her leave?
2) She can avail it sooner or 1week advance?
3) Her HR Rep. said she will not avail her 6weeks salary during her leave, it that legal?
4) Her Mat1 was filed in her company February, she can get it only this month. What will be the right computation for it?
