gusto ko po sana na iconsult yung situation namin ngaun ng wife ko regarding sa loan. Bale yung hiniraman po namin is yung grupo ng tita ng wife ko with her tita as our co maker Ang amount po na kinuha namin april last year is P25K with 10% interest/month, nakapaghulog po kami until september last year around bale total ng amount na nabayaran namin is P35K na, dun sa tita nya namin inaaabot yung hulog namin. Hindi na po namin nahulugan ulit yun kasi ngkaproblem kami financially.

Around dec po last year sinisingil na kami ng tita nya dun sa loan and ang nakakagulat is umabot na sa almost 50K un balance ang katwiran nila is interest daw po yun and penalty kasi dina nkapagbayad since sept, meron pa sla sinama dun sa balance na amount nun dati daw namin na loan w/c is bayad na dapat. Nagbayad pa po ulit kami ng total na 6.5K for dec. Till now po ay pinupuntahan kami sa bahay and binabantaan kami nun tito nya na manggulo pag hindi inayos un hiniram namin kasi sila daw ang nghuhulog dun.

Ano po kaya aksyon na pwde gawin namin para mahinto na ang pang haharass nila. Alam po namin na hindi po namin nabayaran un hiram namin on time kaya nag accumulate ang interest. Pero meron na sila sinisingil sa amin na dpat bayad na. Ang concern ko po kasi is wla kami proof na ngbayad kami tlaga kasi yung dati na listahan namin e knuha ng tita nya kasi aayusin daw yung list nila kasi magulo bnigay naman po ng wife ko kc di nman expect na mgkproblem since pamilya namn cla. Ngayon po hinde na namin makuha kasi nawala na daw po. Ngayon po ang basehan na lng namin is yung listahan nila which is npakagulo at may mga bnayad kmi na hinde nakainclude.

Sinubukan po namin isettle yung dispute kami-kami lng pero wla po nangyari. Hanggang ngayon ganun pa rin po weekly ngppunta cla sa bahay at kung anu ano cnsabi sa wife ko. last time is nag complain cla sa brgy den dun po kami ngharap, npansin din sa brgy un discrepancy. ang nging solution nila is mgbigay na lng kmi ng 1k, den sabi sa brgy na wg na lng pnsinin sa susunod and mangako na lng ng mangako.

Concern ko po ngayon is pregnant ang wife ko and ayaw ko na sya mgalala tungkol dito. Iniisip ko po is hamunin na lng sila na mgfile ng case against samin ang kaso po wala kami proof of payment na evidence sa court, ayaw na rin po namin kasi prang pineperahan na lang kmi, lalo na ang sabi nya ay sa knya na dw kmi my utang dahil sya na ang nghulog dun sa balance. Ano po kaya ang magandang gawin sa situation namin?

Only the loaned amount was specified on the agreement that we signed. We have been borrowing money from them a few times already and have always paid 10% per month interest.

first, the law will only allow you to claim interest if it is in a written agreement. if none, then all you can claim is the principal.

2nd, 10% interest per month is an unconscionable rate of interest. your tita may be a relative, but legally, you don't owe them anything since you already paid more than what you owe.

you can file a case of unjust vexation if they keep harassing you. take pictures and video if they come back.

you can send them a letter stating your position. good luck.

Just a follow up question, can they file a case against us and how can we defend our side if we don't have any proof of payment?

did they admit the payments during the bgy meetings? they will have to perjure themselves before the judge to deny your payments. find some other ways to prove your payments.

they admitted receiving payments from us. will check on our other options to prove payment.

hello attyll, magconsult po ulit ako sa inyo, bale natuloy po yung mga hearings namin sa lupon sa barangay last na po this coming saturday. Sa tinatakbo po ng kaso is mukhang desidido po sila na mag file ng case against sa amin. nag offer kami na bayaran na lang in partial yung alam namin na balance pa pero ayaw nila.

kung halimbawa po ba na mag file sila ng small claims case mag rereflect po ba yun sa nbi records namin ng wife ko? may crminal case po ba na pwede i file against sa amin?

and isa pa po na concern namin is yung agreement na sinign namin regarding dun sa loan is yung wife ko ang nag asikaso, yung mga templated po galing sa mga nag nonotary public. wala po na indicate dun sa interest pero meron alloted space doon na hinde nila na finill up. magamit po kaya yun against sa amin in case ma iakyat to sa korte?

the document can be used to show that you have a loan, but should not be used to prove the interest. do you have your own copy? make sure you can prove that it never had a rate for interest. if they insert an amount, then contest it as unconscionable.

Consult lang po ako ulit. Kasi regarding our case, Hindi po kami nagkaroon ng agreement sa lupon na i settle na lang yung tamang balance, and they said they'll file a case against us. ngayon po we received a letter from which looks like a demand letter. gusto po namin malaman if we need to respond to the letter or should we wait for a court notice na lang if mag file na sila.

no need to respond. but even better if you do to deny liability.
