negligence causing personal injury and damage to property

i was on my way to work riding my 3 month old yamaha mio soul i, a sedan corolla 96 who is going the opposite direction and was on the opposite lane made a left turn causing a head on collision with my bike. i was rushed to the hospital and had some wounds and fracture. now the dude who i collided with wont pay up a single peso. wala daw sya pera or trabaho, the vehicle he was using belonged to his mother in law which was supposedly be impounded right? but by the time my dad to them 3 days after the accident wala na ung sasakyan nila sa police station. di ba dapat impounded un? now im thinking about pressing charges. need legal advice.
