Married Law Student having an affair!

Hi, good day!

Just want to ask po what legal action na pwede ko gawin regarding sa situation ko.

I have a boyfriend, kasala xa sa una, then naghiwalay sila(not legally). We have a 3 year old child, 5 years na kaming nagsasama. Then this March nalaman ko may babae siya.

The fact na from the very start niloloko na pala nya ako na hindi sila totoong naghiwalay nung wife nya, at yung wife niloloko din na wala na daw kami communication. Lately ko lang din nalaman lahat.

The girl na sinamahan nya is hiwalay din sa asawa nya (not sure if kasala sila) may 2 anak.

Ano po ba possible na pwedeng gawin?

PS: He's a law student po sa ADU.

Hi Casey20 I dont think there is any grounds for you yo sue him since you guys arent married. If he is not supporting your kid then you have a strong ground to sue him for RA 9262 economic abuse. But as for his other affairs i dont think you can sue him. His previous wife (not legally separated) can infact sue the both of you. You for adultery and for him concubinage.

You're Welcome. If that is the case you can coordinate with the wife. The wife can file him a case for Concubinage.

Can i ask one more?

Yung panlolokong ginagawa nya (for 5 years) telling me wife and him are separated.

Tapos ang kwento pa binugbog ko daw siya nung malaman kong may other woman, which is i just hit him once (sapul sa mukha) sa galit ko.

No legal case for that also?

C. "Psychological violence" refers to acts or omissions causing or likely to cause mental or emotional suffering of the victim such as but not limited to intimidation, harassment, stalking, damage to property, public ridicule or humiliation, repeated verbal abuse and mental infidelity. It includes causing or allowing the victim to witness the physical, sexual or psychological abuse of a member of the family to which the victim belongs, or to witness pornography in any form or to witness abusive injury to pets or to unlawful or unwanted deprivation of the right to custody and/or visitation of common children.

However you need to prove this in court with supporting evidence that your health was affected by these circumstances. You will have to present any certifications coming from doctors or Psychologist that you suffered from all of these. It actually depends ifyou have substantial proof to prove your case.
