Hi All,

Question lang po regarding holiday pay. Last November po kasi nde ako nabayaran ng holiday. Here's what happened, ngwowork po sa call center under graveyard shift, so yung Nov 30 (Bonifacio day) ma-count siya as holiday kapag pumasok ng Nov.29. Pumasok po ako ng nov. 29.

Nov 25 I received a memo for suspension, unang nkalagay Nov. 29 then binura ng HR gamit lang ang ballpen at ginawang Nov. 28.

Then pay day comes, wala pong na-credit na holiday pay sa akin although pumasok ako nung holiday. I asked yung HR kung bakit, sabi niya dapat pumasok din daw ako ng before and after ng holiday. Wala naman po akong nakitang ganon sa Labor Code. Wala din naman po silang pinakitang document regarding that kung company policy man un.

Iniisip ko po na kayang pinalitan yung suspension ko ng Nov. 28 ay para hindi talaga nila bayaran yung holiday ko. Tinanong ko rin po yung HR about it. Sabi ko nde ko naman po intention umabsent nung Nov. 28, suspended po ako nun. Ang reply po sakin ng HR first-time incident ito so need niya i-consult sa attorney ng company, hindi rin daw niya alam kung paano. So parang nag-duda po ako lalo.

Then nung Dec, sinabi ng HR na as per attorney, hindi nga daw po un mababayaran kasi absent daw po ako before holiday. I asked po for a written document from the HR para po black and white, regarding po dun sa sinabi ng attorney daw ng company, pero wala po siyang mabigay. Nung una po dinahilan niya yung holiday kaya hindi daw nagrereply yung attorney. Hanggang ngaun po Feb na wala pa rin yung document, so parang kahina-hinala na talaga.

Just check the computation:

Example:

If your Basic (the amount you are receiving monthly) is P 6,500 and you are suspended for a day, basically you will still be receiving P6,500 even if you have worked on a holiday since suspension is deducted on your salary. If you have received less than that and the HR failed to explain, you can try file for money claims or non payment of holiday pay at DOLE

The Omnibus Rules to Implement the Labor Code says:

"Employees who are on leave of absence without pay on the day immediately preceding a regular holiday may not be paid the required holiday pay if he has not worked on such regular holiday."

If you worked on the holiday, even if absent (without pay) the day before, then you are entitled to be paid accordingly.

@HR Adviser, I checked my payslip, yes the day when I was suspended was deducted from my salary yet no holiday pay.

@council, pero pakiramdam ko po tinatakot ako ng HR staff namin kasi sabi daw po yung ng company lawyer namin. That's the reason why, I asked for a document supporting what the lawyer said.
