Nagastos ng collector ang pera.

Hi Atty. may pautangan ako dyan sa Pilipinas at may collector to do the collection. More than a year ago nag-loko ang collector ko nagastos ang pera. we tried it sa barangay at nagkaroon ng kasunduan na huhulugan niya kabuuan ng 80 thousand sa loob ng 6 months. Unfortunately hindi siya tumupad sa kasunduan na ‘yun. Nakapag-bigay lang siya ng 3 thousand at hindi na ulit nag-hulog. Lumapit kami sa barangay para i-reklamo ang collector dahil hindi siya tumupad ka kasunduan. Pero hindi sumisipot sa mga hearing. I asked for CFA pero hesitant magbigay ang lupon at madaming discouraging words na sinasabi. Sinabi din nila na hindi maaring sampahan ng kasong estafa yung collector dahil nag-karoon kami ng agreement previously na magbabayad. Naka-usap ng kapatid ko yung collector at sa akin din ay inamin niya na walang na siyang intention mag-bayad. Ano po ba ang maari kong gawin or possible pa din po ba ang estafa?

Yes because the criminal liability of the collector does not extinguish by the fact that you brought the dispute before the barangay, apparently the collector fails to comply with what was agreed upon. Thus, it is mandatory however on the part of the barangay to issue a Certificate to File Action so you can elevate your claim to the proper forum which is to file a formal complaint before the prosecutors office for a case of Estafa as defined under the Revised Penal Code. Sa Kasong nabnggit mo malinaw ang abuse of confidence na na-commit ng collector mo in this regard, you can still go after him and let him hold responsible to his felonious acts.
