Hi, Atty. Im Ms. Garnet, accountant by profession, my former client, filed admin case againts me sa PRC for grossnegligence of duties, paano ko ho ba to maayos?

don't focus yet on 'ayusan.' do you have a copy of her complaint? answer her allegations factually, and relate them to the standards of your profession whether you were unduly reckless or careless in how you handled what ever it was.

you can also ask other accountants to look at your case and hope they can opine that you performed it with the normal standard of care called for under the circumstances, or if you were negligent, then it was not so gross as to require a heavy penalty.

Good pm Atty, am i liable for estafa kung ang employee ko ang pumirma sa voucher na na receive nya yung pera pero di naman naibigay sa akin? nalaman ko kasi na nagbigay ng pera ang cliente ko pambayad, tapos ang nag receive e yun empleyado na di naman binigay sa akin yun pmbayad, paano po yun? pag ng halaga po ba ng estafa e 20 thousand? at ma guilty ka kahit di naman ako kumuha, makukulong ba ho ako? kasi nakalagay din yun sa admin case na complaint ng cliente ko, pls. help me Atty. willing naman po ako bayaran yun, kaso pag kinasuhan na ho ba ng estafa e sigurado me kulong kahit maliit na amount lang?

you have to set up your defense by an admission of your employee of his negligence and produce the money or if he took it, by filing a complaint of qualified theft first with the police then with the prosecutor.

P20k may seem small now, but our penal code was passed nearing 100 years ago so the penalty for this amount is around 4 to 6 years.

i saw your other post, this was for annual income tax? when did your retainer agreement end? before or after 15 april? did the agreement expire or did you terminate it?

I terminate the contract agreement since hindi na ko binabayaran ng cliente,and now, she's accusing me na misappropriate daw yun mga pambayad, some of the checks e hindi talaga tinanggap sa bank kasi may check error, pero sinabi nya sa complaint nya na ginamit ko daw, paano ko magamit e nakalagay sa payee e BIR, then may nakita ako, isang cash voucher na nakapirma na nag received e employee ko before, pero diko naman nakuha yun pera and diko matandaan na inutusan ko sya na kumuha ng pera sa cliente, kaya liable daw ako for estafa, e wala na dito yun employee, nagalit kasi yun cliente ko na na audit sya ng BIR, na hindi ko naman din control yun, and di naman talaga sya nagbabayad ng taxes, eversince nag start operation nya, thats why kinasuhan nya ko gross negligence sa PRC, ngayon admin case pa lang, pero after nito, mag file na naman to, pwede ko ba bayaran na lang yun mga sinasabi nya ?

i did not say that you will automatically be imprisoned. In fact, i doubt it, if you are able to defend yourself properly. you may be comforted by the statistic that less than 30% of criminal cases end with conviction, and if handled properly, even if you were convicted, you would not see imprisonment for a long time.

i would recommend that you change your frame of mind. you are so scared of imprisonment that you are not even considering the defenses available to you. you are immediately jumping to paying P4M?? tax evasion is ultimately the obligation of the tax payer not the accountant.

the best move you can do is to get a lawyer to start preparing your defense. i assume the notice you received gives you a number of days to respond. if you don't know a lawyer, you can contact the ones here through private message.

in preparing your defense, i would recommend to first review any retainer agreement that you had with your client and see the respective obligations. you should also gather all related documents such as communication, these checks, vouchers etc.

if you validly terminated the retainer agreement, then you no longer had any obligation to provide service to the client. if there were error in the checks, show what they were and that you communicated these problems to the client.

don't waste what time you have by just focusing on settlement. you have to prepare and submit your defense. settlement can come later once they see you will fight back.

My problem is, I didnt send her yun formal termination ng contract kasi, year 2005 lang yun may written contract namin, pero nun Oct. 2009 to Jan 2010, she didnt answer to any of my text messages, or calls, and dina din nakabayad ng retainer fee ko, then nun lumabas yun formal demand letter ng BIR sa kanya, dun sya ulit nakipag communicate sa akin, now ang complaint nya, diko daw sya sinabihan na dipa tapos ang audit sa kanya, Atty,. kahit ako ang accountant nya, diko naman din sya makausap o makita kung ayaw nya makipagkita sa kin that time, and kahit sabihin ko na dapat magbayad, e ayaw naman nya, sya ang business owner, responsibility nya na sya ang tumingin sa business nya, hindi sa akin, I can only give her yun mga nangyayari and still decision pa din nya ang pagbabayad and kung kelan nya babayran, di naman sya bata , alam naman nya yun, pero ngayon lahat binabaligtad nya, di naman aabot ng matagal ang services ko sa kanya kung di naman din nya nakita na may ginawa din ako, na serice for the company, bakit umabot for almost 4 years ang smahan namin kung tingin nya wala ako nagawa,? at trinabaho for the company ?
