Hi po patulong po ako kasi po trainee palang po ako sa isang restaurant ang wala pa kong pinipirmahan na kontrata o kahit na mag accept ng duties and responsibilities wala pa talaga akong pinirmahan. At nag decide ako na gusto ko na mag resign dahil sa ang owner/operator ay laging mainit ang ulo, araw araw na lang naninigaw kahit konting pagkakamali lang or typographical errors lang na madali namang baguhin at pati ang supervisor ay may pagka bully din, nag decide akong umalis dahil sa naaapektuhan na ang mental health ko. Kaya last week gusto ko na sana kausapin yung boss/owner ng restaurant na mag reresign na ako at iaabot ko na sakanya ung resignation letter ko. pero ng tinanung ko yung senior ko(dahil nakaleave si hr/supervisor) kung kakausapin ko na ba ung boss sabi nia dapat daw sa supervisor muna. edi tinawagan ko nalang ung supervisor ko at sabi ko na mag reresign na ako tapos sabi ko din na iaabot ko na lang dun sa senior ko habang wala pa sya. ang sinabi naman ng hr/supervisor ko eh di nia daw iaaprove ung letter ko kasi dapat daw eh ibigay ko sakanya personally and di daw valid ung paguusap namin through phone. sabi nia pa na marereceive lang yung letter ko pero di nia daw yun iaaprove kasi un nga na dapat personal ko ibigay. and sa company policy pa daw na dapat mag bigay ng resignation 1 month prior ka umalis kasi mag tuturn over pa daw ng work at icocontact pa daw yung head office para sa computations ng salary kasi baka daw meron pa kong bayaran kasi nag early-out daw ako and may isang leave. ang sabi ko na man sakanya na "mam wala pa naman po akong pinirmahan" and sabi nia na "oo mam, pero binigyan ka na namin ng full salary (as in hindi allowance pero ung pang regular employee)". At sabi nia pa na ok lang daw yun na mag resign ako kasi di na din naman nila ako mapipigilan. pero wag daw ako hihingi ng referral sakanila kasi di naman sila magbibigay daw kasi nga ng dahil daw sa ginawa ko. At sabi nya pa na maliit lang daw ang business community sa province namin at pati na rin daw sa manila kaya baka daw mag krus ang mga landas namin at kapag makapag apply daw ako sa iba na baka konektado daw sa kompanya eh ganun nga daw na di sila makakabigay ng magandang feedback saakin(parang pinapalabas nia na ipapa black list nia ako sa mga suppliers/kasosyo nila).

Patulong naman po ako.. kasi po ang concerns ko po ay:


  • tama ba na dinedelay pa ng supervisor ko ang aking pag alis kahit na wala pa naman akong pinipirmahan? pati ang di nia pag approve at pagtanggap sa aking resignation?


  • di naman po ako humihingi ng referral sakanila pero natatakot din po ako kasi baka kung saan saan ako mag apply eh di ako tanggapin dahil baka may transactions sila with the restaurant eh baka naka black list na ko dun at di na ako makapag trabaho


Anu po ba mapapayo niyo saakin? Patulong naman po ako. Maraming maraming salamat po talaga sa makaka bigay ng advice saakin.

Regardless of having a contract or not, you are oblige by law to render 30-days notice. Since you failed to render 1 month notice, they can opt not to receive your resignation. You will not be black-listed but if your future employer would do a background check and discovered that you are tagged AWOL in their company, it is less likely that you will be hired.

What if I applied in a different company but it is one of my current company's supplier. Would they still find out about me being AWOL to their customer? even if I don't include my past employment in my resume? And don't mention it during my interview?

Yes if they are able to see it in your SSS, Tax, Philhealth and PAG-IBIG. If I were you, just go to someplace far and start anew if you really feel that your opportunity is limited due to your previous employer. I don't recommend you to disregard your experience in your resume because your are committing dishonesty/ alteration of facts which might lead you to worst sanctions in the future.

But what if I get clearance from my current employer? Would it make a difference than if I go AWOL? Will my future employer still see it in my sss, philhealth, tax and pagibig?

It's up to them to clear you or not but your previous company will never be erased in your government mandated benefits.

Thank you po. Another question po pala. Lahat ba ng employers malalaman ang mga previous employers mo through sss, philhealth and pag-ibig o kung mag bback ground check lang?
