Hi!

May tanong lang ako.. kasi yung wife ko kasama ko nagmigrate dito sa ibang bansa. Gusto sana namin makuha yung daughter niya na nasa Pilipinas pa as dependent niya. Kaso bata kasi siya nagkababy yung mother niya for some reasons nadeclare yung anak as sister niya. Kaso namayapa na both parents ng wife ko so hindi namin alam kung pano namin makukuha yung anak niya kasi sa birth certificate ay declared as sister sila, hindi naman ppuwede makuha kung hindi niya anak.

May way ba sa batas to correct this?

i can't talk about the foreign law

however, to correct the birth certificate, i would first get a dna test and then file a case for correction of the birth certificate

Thanks very much attyLLL, that's fine as foreign law is irrelevant to us at this time as we only want to correct this information in the birth certificate as soon as possible.

When DNA test result is available, how long does it usually take to go through the court for cases like this? Months? Years? Does my wife needs to appear in court to do this or can she be represented by a lawyer?

another option is to adopt her baby, i assume still minor,but then again, cguro naman magiging cooperative sya, kasi para sa kanyang kapakanan yon.
tingin ko mas madali to, yun nga lang, need nyo pa ring balik ng pinas para dito.

Hindi kaya mas matrabaho ang proseso ng adoption? I mean anak niya naman kasi talaga, which can be proven by DNA test. I guess we just want to get an idea kung paano ang proseso at gaano katagal puwede abutin para maset na namin ang aming expectations.

DNA testing for one cost something...
with adoption, since declared parents were already dead, the guardians will be the next person u need to give consent of the process, and since by declaration is sister, she can be a guardian.

nasa inyo yan, ano mas prefered nyo...
