Sir/Ma'am,
Gusto ko lang po ng enlightenment kung ano po ang naaayon according to our labor laws.
The company where I am currently working got burned last May 31, 2013. 40% of its facility was gutted by fire.
After a day, the company sent a notice to its employees that it advised DOLE of Temporary Shutdown not more than 6 months.
Ang question ko po, meron pa ba kami dapat i-claim sa company or we'll just have wait & see.
Ano po dapat ang naayon sa labor law natin in terms of employee claims & ano pa ang obligation ng company sa kanilang mga empleyado?

suspension for operation for not more than 6 months is legal and allowed under the labor code.

it's a tough situation. if they call you back and you do not, you will be considered resigned. but if it lasts for more than 6 mos, you will be entitled to separation pay
