Arresto Menor

Gusto po sana namin humingi ng tulong base sa mga sumusunod na facts:

1. Nagbreach po kami ng contract, dahil ung nirentahan namin unit, pinasublease po namin.
2. Agreeable po kami na waived na ung 2months deposit sa owner (P38,000) kahit na 2months pa lang po kaming nasa contract.
3. Ang kausap lang po namin is ung broker, at ayaw daw po kami kausapin ng owner dahil baka mamura lang daw kami sabi ni broker.
4. Sabi ni broker, gusto ni owner na:
- remove all tenants (bedspacers)
- vacate the premises by August 30, 2013 (August 29 na po ngaun, August 23 nung sinabi ni broker sa amin na umalis)
- hindi mapupull-out ang appliances sa unit, dahil daw sa damages sa unit
5. Tinext ako ni broker na ban ako na pumasok sa building kung san ung unit (di ako doon tumitira)
6. In between August 23 - August 29, nagooffer ako sa broker na magbabayad ako ng rent ng August 30 (from own pocket since di na magbabayad sa akin ung tenants gagamitin na nila deposit nila sa akin) to extend ng 30 days para makalipat ng maayos ung mga tenant. He told me na pagiisipan nya so I assumed na wala ng effect ung 1 week na binigay nyang notice to vacate. Pero yesterday (Aug. 28) sabi nya August 30 pa rin. That leaves us 2 unreasonable days lang to move.

Questions:
1. Dapat po ba manghingi kami ng Eviction Notice from owner?
2. May right po ba ung broker na hindi irelease ung physical assets namin sa unit?
3. May right po ba ung broker na iban ako sa unit?
4. Kapag breach of contract, ilan po ang maximum days na pwede namin hingin to extend?

Please help po. I'm very much concerned din sa tenants ko. Thank you so much.
