Child Support and Custody

Hi,

I need an expert's advice on my concern. Five months ago naghiwalay kami ng live-in partner ko. Our son is 1 yr old and sa akin napunta. As of now, nakatira kami sa bahay ng mom ko. He regularly visits his son (every Saturday), and doon natutulog ng Saturday night and he returns him by Sunday morning.

For the first 2 months, kumpleto yung bigay niya. When he returns our son Sunday morning may dala na siya Milk na good for 1 week, diaper and baby soap.

On the third month, Milk and Diaper na lang. And for the whole month of June eh Milk na lang dinadala niya, wala na diaper or anything else. Tama na ba yun na sustento sa anak niya??

Also, sa three years na tumagal ang relationship namin (including hindi pa kami live-in), nakautang ako sa kanya ng almost 110,000 pesos. Dapat bang makaapekto ang utang ko sa sustento niya sa bata?


Lastly, dahil walang pang 7 ang bata eh automatic sa akin mapupunta. I just have this fear na pag lagpas na siya ng 7 eh bigla siyang mghabol. I have a stable job and I can support for my kids (hindi nga lang buhay mayaman). Ano ang percentage na mapunta sa kanya ang anak namin once lagpas na siya ng 7 yrs. old.??

the support he provides is for your son, not for you, so it has no effect on the debt.

the maternal preference during the tender years, imo, is not relevant for illegit children where the mother will always have sole parental authority and right to custody.

yes, the child is entitled to support, but you have the burden of proving that the guy is the father because it doesn't seem he signed the birth certifiate. a dna test is best but is very expensive. try to negotiate a support agreement first.
