sir,good morning ,we have a problem about the subpoena na dumating sa asawa ko na GRAVE THREAT AND PHYSICAL INJURY.paano po namin mapapatunayan na ginawaan lamang ng kaso ang asawa ko ng pananakit at panunutok ng baril na hindi naman totoo at taliwas sa totoong nangyari?kasi po kinasuhan namin ng reckless imprudence ang taong to dahil sa pagkakabangga nya sa anak ko mas nauna po kaming magfile ng demanda pero bakit asawa ko ang nabigyan kaagad ng subpoena?april 2 po ng kami ay magfile at april 4 naman po ang kabilang panig.ano po ang dahilan bakit wala pa balita sa ifinile namin?ano po ang pwede naming gawin upang mapatotohanan na ang akusasyon sa asawa ko ay walang katotohanan.

do you have a copy of the actual complaint against you? study the factual allegations carefully and try to disprove them first with evidence other than your own testimony. perhaps there were other witnesses, a document, video, etc.

prepare your counter affidavits, it is always better to have help from a lawyer and defend against their counter-charge.

as for your own complaint, you should check at the prosecutor's office and let them know that there is a related counter-charge so it can be consolidated. you can also ask what is the status of sending the subpoena.

It's mandatory for you to submit your counteraffidavit. Your failure to do so would lead the prosecutor to resolve the issue based from the affidavit and evidence submitted by the complainant. If he sees that a probable cause exists, he will file an information before the court and if the judge agrees with the prosecutor after evaluating the documents submitted to him, he will issue the corresponding warrant of arrest.
Where did the other party file their complaint? Is it before the same prosecutor's office (city or provincial) where you filed your own or somewhere else?
