I was hired as a provationary employee in April , 2013. I know that I signed a contract that anytime my employer may terminate my employment. My employment was terminated May 29, 2013, barely 2 months form the date I signed my employment contract. I was given a notice of terminatiopn on the same date (May 28, 2013) and told me that it was my last day in the company becousae of poor performance.

Is this legal? I was not given a change to defend myself and I was not given the 30-day notice, I thoguht that it was unfare that they just terminate me and sent home.

Can I sue my former employer? and on what grounds?. I hope to hear from you soon, Thanks.

probi ka pa lang kasi at nakalagay sa contract mo anytime within that probi period pwede ka ma terminate.. iba ang case kung regular employee ka na..

my opinion is that a probationary employee has security of tenure during the probationary period, and any termination due to cause has to undergo due process.

you can file a complaint for illegal termination at nlrc, but as to expectation of an award, the max will be completion of the probi period, or 4 months of salary.
