Arresto Menor

Hi, Our company is not yet given our 13th month pay since 2011. I'm still employed with this company right now. They promised us that they are going to pay us when the turn of income got stable. However, Feb 2013 they changed the name of the company, they hired a new HR and I they told us that everyone will become probationary again. Please advise what to do or is there a way we can claim our 13th month and all other mandatory payment- Thanks
