good day po. Atty.
Bumili po ako ng bahay at lupa noong 2006 pero naka-mortgage sa NHMFC. Ngayon po ay fully paid ko na yung property at hawak ko na ang original title with encumbrances dahil nga mortgaged ito sa NHMFC. Hindi ko pa po ito napacancel sa Register of Deeds. Hawak ko po lahat ng documents given by the NHMFC from the original owner including the Notarized Deed of Sale. Ang problema ko po ay ganito: Yung Deed of Sale po namin ay 2006 pa at napanoratized ko na din noong 2006. Nalagyan po iyon ng date sa notarization ng parehong year. Sabi po sa akin ng nanay ko, malaki na daw po ang penalty ko sa BIR, sa Register of Deeds, etc. dahil ang tagal na yung panahon na yun at di ko pa po inayos ang mga kailangang ayusin after mabili yung rights. 150,000 lang ang bili ko sa property dahil itinuloy ko pa ang pagbayad sa NHMFC. Ngayon po ay 350,000 na ang value ng property. Magkano na po sa tingin niyo ang babayaran ko lahat-lahat kasama na ang penalty? Wala pa po akong ginawang improvements sa property, kung anong itsura nong panahon na binigay ng gobyerno ay ganon pa rin ang itsura hanggang ngayon. Plano ko pong magpagawa ng bagong deed of sale pero di ko na makontact ang owner dahil bumalik na daw po sila sa probinsya.

Ang alam ko ay ung halaga sa Deed of Sale or Tax Declaration market value or BIR zonal value whichever is higher and pagbabasehan sa Capital gains tax at documentary stamp tax sa BIR. Sa Register of Deeds dapat ay naka-annotate rin ung full payment mo sa mortgage at palagay ko hindi ako sigurado, ung date ng deed of sale ang pagbabasehan as long as you are paying the realty tax since you started paying the mortgage up to the time you have fully paid it. Suggestion ko, ask the BIR, Register of Deeds, Municipal Treasurer's Office wshat these departments need to transfer the property to your name. Bawa't agency may kanikanila silang requirement.
