Hi Atty.,

We've been renting an apartment in Iloilo City for 15 years. The rental fee for now is P6500. I am aware of an RA that only allows 7% yearly increase until Dec. 2013 as long as the lessee is the same. Now, somebody considered himself the new lessor of the whole 4-door apartment that includes ours, and thus us, a new lessee as well. So he plans to increase our rental from P6500 to P10,000. Is that lawful?

Ayon sa kuwento mo Mr. Gonzaga ang kontrata mo sa may-ari ng apartment ay sakop ng New Rent Control Law dahil sa ang upa mo kada buwan ay P6,500. Sakop ng batas na ito ang lahat ng paupahan na residential na may paupang hindi hihigit sa P10,000.00.


Ayon sa nasabing batas, maaari lamang na taasan ang upa ng hindi hihigit sa 7% ng nakaraang halaga ng upa. Samakatuwid ay mga P525.00 lamang ang dapat na itaas ng upa mo kada buwan.



Puwede mong tutulan ang pagtaas ng upa ayon sa gusto niya dahil labag ito sa batas.


Kung hindi niya tatanggapin ang bayad mo ay gumawa ka kaagad ng sulat kung saan mo sasabihin na handa na ang pambayad mo at itanong kung saan ibabayad dahil sa ayaw niyang tanggapin ito.



At kung patuloy ang pag-iwas niya sa bayad mo ay ideposito kaagad ang bayad sa bangko na ipapangalan sa kanya o kaya ay consign o ipadeposito sa korte dahil kapag hindi ka nagbayad ng 3 buwang sunud-sunod ay magiging dahilan ito upang ikaw ay mapaalis sa inuupahan mong apartment.
