Hi. Back in march 2010 I bought a car from a buy and sell person who posted his ad on ayosdito. He assured me that the car had not been flooded. However, when I brought the car to a qualified electrical person to look over the light in the dash that would not go out and the windows were jamming, I was informed that the electrical wirings were shot and that it looked like a flooded car. 2 months later the aircondition konked out and in the middle of traffic the car suddenly stalled and would not run. Opinions from 5 (yes, 5..) different mechanics were all the same --- the transmission gave out. The mechanic who overhauled the transmission informed me that there was evidence of rust and "lumot" when they pulled out the transmission. A few days later, the fuses also went out. I am scared to drive this car for fear it will stall again. I have been informed by another seller that I have legal rights to return the car to the seller since the sale is fraudulent. What legal actions can I take and what can I reasonably expect to happen? Where can I find a lawyer to take on this case and what costs shall I incur? I have told the seller, been to his house, and he is giving me the run around. Please please I need help!

purchase of 2nd hand cars are on as-is where is basis, but if you can prove that you specifically asked whether the car had been flooded then you may have a cause of action that there was fraud or there was a hidden defect.

you have to initiate an action within 6 months from getting the car.

you may also consider filing a small claims case if the damages will not exceed 100k. you won't need a lawyer, but you will need evidence. good luck.
