Purchase of flooded vehicle

Hi Sirs,

may question lang po sana ako...Last March 2012, bumili po ako ng kotse sa isang car dealer. Maayos naman po ung kotse, mukang brand new and mababa ung mileage nung kinuha namin sa shop ng dealer. We have asked the agent a number of times kung flooded ba ung unit, and repeatedly he denied it in front of me, my boyfriend and his brother. Earlier this week, nilinis ng bf ko and his brother ung aircon ng kotse and they noticed some corrosion dun sa internal parts nung sasakyan, which raised suspicion nga that the unit may have been flooded. So we checked against Mazda by calling a couple of their shops to confirm our suspicion and yun nga, flooded unit nga daw.

Now my question is, pwede po ba akong magfile ng case of fraud with the car dealer/agent? if not, what other case can we file against them? Sobrang taas po namin nakuha ung unit dahil ang sabi nga po nila sa amin is good as new nga daw ung kotse (with 10K mileage and really nice paint finish with only minor scratches) and ang gusto sana namin at least makuha ulit ung kotse na trinade in namin (or anything of same model and make) and makuha lahat nung na cashout namin for the insurance, chattel mortgage and other processing fees...pwede po ba namin ituloy sa court yung reklamo namin?

you can sue for damages or rescission of the agreement, but it will depend on the evidence whether it will prosper

Thank you sir. ano pong evidences can we use to pursue the case? may record sa casa ng manufacturer that the vehicle was indeed flooded, and I have SMS conversation with the agent with him denying that it is a flooded unit. enough na po ba yun or do we need other evidence?
