tanong ko lang po. ano po ang iniinclude na makukuha sa backpay? at ano ang pagkaka-iba nya sa separation pay?
sino lang ba yung mga entitled na makakakuha ng backpay and separation pay?

sana po makasagot kayo..thanks

moderator

backpay normally refers to just days worked but not yet paid. but after a case of illegal termination, back pay will refer to the salary to be paid for the period since the illegal dismissal.

separation pay is given in cases where the employee is terminated for authorized causes such as retrenchment, disease and redundancy

thanks for the reply atty..
ask ko din po kasi nag-file ako sa nlrc ng constructive dismissal against my employer. tapos on our 2nd hearing nag-ooffer ang company ko sa akin ng 85k for my backpay. kaso lang po pra sa akin mababa po dahil 9 years akong nag-serve at ang expected ko po ay aabot ng hundred plus. tapos doon po sa 85k hindi po nila ininclude yung leave conversion ko na hi-nold nila pati yung salary ko na naka-hold.
paano po ba ang computation for backpay at pwede po ba ako mag-demand ng mataas dahil alam kong mataas ang backpay ko.

moderator

during mediations, the computations are irrelevant. the only question is whether you will accept the offered amount or not. you can ask for higher but they are not obligated to accept it also.

I have the same situation sayo, better draft a computation of the following.
1. 9 years mo na separation pay, a year or at least 6 months is equivalent to 1 month of your salary.
2. backpay mo, mula nagaun hanggang sa last day mo sa kanila. Use per month na sahod mo.
3. Yung Servce Incentive Leaves mo na unsused (VL at SL) bilangin mo na mula now hanggang last day mo. Kung ilan yun, itimes mo sa daily rate mo. (To compute yung daily rate mo, 1 month salary divided by 20 working days i.e. 15,000 monthly salary divided by 20 working days)

4. damages, if you want to inlude that. You can use kung ilang months na ang lumipas na di pa nasesettle ang case

5. atty's fees

Ang TIP ko sayo, na naging tip rin saken, TAASAN mo ang demands mo. ICOMPUTE mo na para me figure ka na na target for settlement. Then it is up to you if matatanggap mo ang ioffer nila. Otherwise, proceed na layo sa position paper so NLRC can decide sa lahat lahat.

yang leave conversion depende sa policy nang company yan.. may ibang company na hindi nag co convert.. ang mandatory lang eh 5 days per year.. the rest pwede nilang i forfeit pag di nagamit depende nga sa policy.. so check mo yung policy nyo kung nag coconvert ba nang unused SL/VL before you contest it.

Hi atty. Sir tanong ko lng po, august 25 2009 po ako na employed bilng project base. August 16 2010 nag sign nanaman ako ng kontrata 1year contract. 2011 august hnd na po ako piƱa sign ng contract hngang 2013 June 1. 2013 June 2 pinapasign kmi ng contract ,ang pinapasign po smin ay 2011 at 2012 at 2013 kontrata ... atty tnong ko lang po Kung may nilalabag na un company nmin,, binigyan kmi ng 1week pra isign ang contract. Kung hnd raw eh iteterminite nila kmi kc daw Wla kming contract. Atty ano po lban nmin Kung hnd kmi pipirma.....salamat po!!!

e sabi nya project base, e di naka stipulate lang sa contract ang period of employment..pag nag sign sya ibig sabihin fully aware sya na the contract can be terminated anytime. Review nya muna kung anu ang nakasulat sa contract.
