Hi. Can a private company in order to save costs implement new rules for future incoming employees totally different from those being enjoyed by incumbent employees? The new rules would affect mainly the bonus which they are giving out. They want to lessen considerably the amount which they have been giving out for the longest time and since they think it would be hard to subject the incumbent to these changes, they are thinking to implement on new ones coming in.

Thing is, they have a CBA with union. How can they implement the new rules without being accused of unfair labor practice?

Would really appreciate thoughts on this.

What about the fact that bonuses merely being gratuitous acts of employers? Are employers now without recourse especially since the economy has changed and the business is not as profitable as before?

if those bonuses are not listed in the cba, then it remains to be within management prerog whether to give bonuses.

Hi This is Hans. I have been employed one time in a small scale testing center. They said that probationary employees are not entitled to SSS benefits, Philhealth benefits and Pag-ibig benefits. And also I was harrased by the general manager on an issue that I did not do. Here is the story, One of the reagents needs to be dried over the oven as a Chemist, I did get out of my way to dry the reagent. I was falsely accused of not drying the reagent and she said that "THIS WILL APPEAR IN YOUR EMPLOYEE 201 FILE." Which I did not do. Kindly comment on this?

But the statutory benefits that are included to us is only income tax and overtym pay. No SSS, Philhealth and PAg-ibig. Do I need to write a demand letter to DOLE?

Please comment on yesterdays answer because I will be giving my decision to the board so that the situation will be resolved by filing a demand letter through DOLE and they will forward to the company.
