Tanong lang po if a mother of a 6 year old child accuses someone na hinipuan anak nya does that count as statutory rape? Even if yung mediko legal states na negative lahat even trauma sa bata wala do they still have a strong case?

I know someone kase that got jailed dahil may hinipuan daw na bata and staturory rape ang kinaso.

Ano po opinion nyo dito?

Walang satutory rape dito. Hindi naman na rape yung bata (walang pentration sa vagina, mouth, or anus sa pamamagitan ng penis o ng instrument or object).
Maaring kaso dito ay acts of lasciviousness in relation to RA 7610 (child abuse law) if yung panghihipo ay ginawa dahil sa kamanyakan. Yung sa nakulong dahil may nahipuan na bata at nakasuhan ng statutory rape, nako, eh, ang malas naman noong tao nayon dahil biktima sya ng wrongful conviction. walang rape kung hipo lang ang nangyari.

What is the difference between "motion for reinvestigation" sa "motion to quash"? Nababaan na kase ng kaso and statutory rape pa din ikinaso so non-bailable talaga. ANo po ba mas effective if you want to review/change/babaan ang kaso to a bailable one?
