Question Regarding Delinquent Payment in Condo payments & Eviction

Arresto Menor

Hi po, i just wanted to ask a legal question regarding payments in arrears and eviction;

My father kasi tried to purchase a condo unit at 800k when he was a senior citizen. It's inhouse financing with the developer and they only agreed to 5 years of payment since i think they considered the age of my father.

So 2 and a half years into the payment, we've already paid around 500k of the 800k due but had to stop due to unemployment and financial reasons.

2 years after, di kami nakakabayad ng interest and payments for the completion of the 800k unit. Pero we have sufficient funds naman for small expenses like lighting energy etc. In those 2 years, the developer tried to indirectly evict us by disabling the water to our unit (which was operated by the developer since NAWASA/Maynilad cant support water systems for highrise buildings, or so they explained.)

My father kept discussing with the developer na ung payment is being proccessed and being financed by the lumpsum benefits from pagibig / SSS (which we later found out to be false as he already withdrew the amount far earlier)

Feb this year, my father has died and i was planning to pay the balance since ive started working. However they have verbally asked us to leave the premises.
We tried to negotiate with them with showing proof of income from the new company i will be working with, and they requested it to be given to them mid march , only a few days after my scheduled first day in the new company. However due to several complications with my past employer, my scheduled first day in my new company is set in april 1, way past the mid march deadline that they have set.

Now they are asking us to vacate the unit asap or they said they will officially write a letter for us to legally evacuate.

What i want to ask is that, if the death of my dad would equate to his debts being written off ( even if we havnt paid the remaining balance for 2 years )

If it cant be written off, what can i do so that i may able to continue paying the balance and finally finish paying off the unit?

For all those who can give anything to help us, we thanks in advance.
