forced resignation

hi i want to ask po if this is legal. my husband worked for the intl company for 6 yrs he was a free lance employee as specified in their contract. he worked almost 12 hrs a day 7 days a week as a free lance employee. recently he was given a memo that he broke the rules of their contract..he was falsely accused of something he didnt do. something to do with their computer encoding..he was given 42 hrs to give written explanation. he gave his written explanation stating that it was a computer error. and now he was given 2 choices to resign immediately or to be terminated. is this legal? my husband is very professional, no misconduct or misbehaviour in his 6 yrs of service.

in spite of that contract, imo, he is an employee. as for the basis for dismissal, it will depend on the evidence.

Hi gusto ko lang din po magtanong about sa force resignation. pinagreresign kasi kami ng agency at yung resignation letter ay pinapakopya lamang nila samin at nakalagay po doon na hindi kami mghahabol ng kahit ano sa company, ako po ay 13 yrs ng empleyado ng kumpanya at ng agency. Ginagawa daw po nila itong pagpaparesign samin dahil mgpapalit ng pangalan ang kumpanya, ngunit pipirma din kami ng bagong kontrata s bagong kumpanya,. Wla po ba tlga kami pwede ihabol na separation pay sakanila kung sakali.
At saka po my cashbond po na kinakalatas ang agency samin, 100 weekly po, kadarenew po namin ng 5mos. binibigayan lng nla kami ng 2thousand galing sa cashbond, at ang cashbond po na yan e sya rin pinapautang nila s ibang empleyado n nangungutang at maytubo(10%), ngunit un kinikita nila sa cashbond namin e sakanila lamang po npupunta.
