Good day sir/ma'am,

I am a regular employee, working for 1 year in one of the company here in the Phillipines. I heard some news that I will be terminated because of my attendance.

Is it fair for us employees to be terminated by our employer without prior notice?

Is this against the law?

Hoping for your response..

Yes it is fair PROVIDED the dismissal is anchored on just or authorized causes as provided under the labor code.

Just in case your services has been terminated WITHOUT PRIOR NOTICE, then you can ask for DAMAGES for that in form of MONETARY PENALTY against your employer for failure to observe the due process, but it doesnt mean that you can be REINSTATED to your previous work/position. UNLESS the dismissal is not one of the JUST or AUTHORIZED causes as provided by law.

Not against the law if the dismissal is based on JUST and AUTHORIZED cause, there is only procedural defect that would punish the employer for failure to oberve the due process.
