I am in deep trouble right now and I was hoping you can give me answers on what to do. I was charged of Serious Misconduct by our company, I may have violated a certain policy in our code of conduct however when such violation was committed I am in good faith. I was aware of the policy but not fully aware that such violation is within the scope of serious misconduct. Our code of conduct only states Serious misconduct and a terminable offense but wasn't clearly defined to us what serious misconduct is or what are the cope of this section. I have been with the company for 3 years and such act has already been a practice by everyone. Even supervisors and team leads does know it's happening and they also tolerate it. So, I was under the impression or assumption that I was just doing right and not violating anything when the alleged violation happens.
Now atty, I am scheduled for an administrative hearing but I still don't know how to get it through. I have drafted my notice to explain already and and stated that I was in good faith that I am fully unaware that I am violating something in the policy.
Should I bring legal counsel to the hearing? Or should I let them decide first of what sanction should be issued to me and then contest?
