Hi All,

Good morning!

Nagkaroon po ng revision sa Attendance Policy sa work namin na nag-take effect last Feb. 1, 2017. I was sent home last January 31, 2017 due to sore-eyes by the clinic Doctor. Bumalik ako ng work after 2 weeks na may fit to work na. Ngayon po gusto ako i-terminate ng immediate supervisor ko based on the guidelines of the new Attendance Policy pero kung sa previous policy po hindi dapat mangyari ito. Nalaman ko lang po ang tungkol sa pagbabago sa Attendance Policy habang nka sick leave ako at hindi ko pa rin nakikita yung changes until before ako nakabalik ng work. Wala rin akong nasamahang orientation tungkol sa new Attendance Policy hanggang ngayon. Dapat ho ba na i-apply agad sa akin yung bagong Attendance Policy given na una nagsimula ang absences ko before nag take effect? At wala namang notification nor orientation na nangyari?We weren't even aware that a plan to revise the Attendance Policy was happening before it was implemented.

ang tagal naman ng sore eyes mo. Medyo harsh naman if ni terminate ka just because of this incident. Binigyan ka ba ng NTE? Ano ba yung bagong attendance policy? Ano yung dati?

Thanks po sa reply. I really appreciate it. I don't really know why it took that long to be cured. But I have complete medical documents to account for this and they have verified this already with the clinic/ doctor I went to. What I was issued now is a "Show cause memo" but it indicates that the charges I am being alleged with are punishable by Dismissal/ Termination.
They are using one of the new guidelines in the recently revised Attendance Policy which states that "For regular employees, excessive absenteeism shall refer to an accumulation of six (6) total unauthorized/ unscheduled/ NCNS absences whether consecutive or non-consecutive" and that the penalty is Dismissal po. Wala po ito sa dating Attendance Policy. So one of my questions is this; Should the New Attendance Policy be applied to me right away? Even though I haven't attended any orientation about it nor signed any acknowledgement that I had been informed of the changes therein? I know they have and probably are still conducting orientations regarding the revisions in our Attendance Policy and are getting sign offs from the employees. They are also citing "Gross and Habitual Neglect of Duty" from the Labor Code.

Please advise.

Maitanong ko nga po pala, tungkol dito sa Show Cause Memo na issued sakin. Ibinigay po ito sakin last March 2, 2017. At nkasaad po dito na mayroon lamang po akong five(5) days para magsubmit ng reply or explanation. Marami po akong dapat ireview sa mga kasong binabanggit nila dito kasama na ang pagpapatunay na nakapagsabi o nakapag notify ako sa aking supervisor na ako ay may sakit at di makakapasok. Hindi po nila ako binigyan ng permiso na mag leave nung Friday, March 10, 2017 para sabi ko ay magugol ko sa pagsasaayos ng mga kailangan ko ukol dito sa charges nila. Sabi ko na dahil sa timing ng pag serve ng SCM sakin na dadaan ng Sabado at Linggo bale dalawang(2) araw po akong wala halos magagawa kung balak kong sumangguni sa isang abogado dahil alam ko walang opisina ang PAO at NLRC. Pero talagang ayaw nila akong payagan, dahilan nila ay kailangan daw ako sa opisina dahil mag teturn-over ng mga bagay bagay yung kasama ko na magreresign na dapat sa March 30, 2017. Reason ko naman po, e wala ring pakinabang na nasa opisina nga ako tpos pagdating ng ika-5 araw e mateterminate naman ako. Pero pinanindigan talaga nila na wag akong pagbigyan. tama po ba ito? Ngayong Lunes napilit ko silang payagan ako dahil kahapon nag text ako sa 2 kong boss na parang natatapakan na ang karapatan ko sa ginagawa nila na pagpigil sakin na maayos na masagot ang mga paratang nila sakin. Lalo na yung "Gross and Habitual Neglect of Duty".

yes tama lang yun, kasi ang normal ay 72 hours lang ang binibigay. since binigyan ka nila ng 5 days sobra na yun
