Help about my friend.

Nakipagdeal sya with another friend na maglending. Yung friend ko ang papasok ng clients and sya din ang pumirma. Unfortunately, may mga di nagbayad at yung friend ko, nakagastos din dun sa ibang collection. Ngayon hinaharass sya ni lender. Pinipilit sya magbayad and pinapirma ng latter and pinagissue ng PDC with the full amount. Question ko po is.. 1) What if di pa nabayaran ng buo yung utang, estafa po ba yun? 2)If ever na kasuhan sya ng estafa, matatanggal po ba sya sa trabaho? Makakapagtrabaho pa ba sya uli? 3)Ilang taon ang kulong ng estafa?

1. Not estafa, but only a civil case for collection of sum of money.

**2. If ever na makasuhan ng estafa, depende rin, if maka bail sya then hinde sya matanggal sa work, pero pag hinde sya maka bail, im sure matanggal sya kasi nga palaging absent sa work kasi andun sya sa jail. Till the decision of the court.

**3. Makapagtrabaho sya uli? depende sa outcome ng case, if ma acquit sya den makatrabaho sya, if hinde, makulong sya den hinde sya maka work.

**4. ilang taon ang estafa? depende sa court order, after taking into consideration the amount.

-yung may mga "**" if ever lang yun kung estafa ang case nya ha.

Estafa is punishable under Revised Penal Code(RPC), it is a criminal case, thus, once convicted by the court, the penalty is imprisonment.

There is no estafa in civil case, what i meant is a case for collection of sum of money, thus, once declared as liable thereto, the penalty of such is only "payment of the obligation" + payement for damages OR having a lien over the property.
