Hi! I just want your opinion and legal opinion as well para may basehan.

Situation:

I bought a property and entered into additional transactions with the developer. Financial transactions to somehow ease the terms of payment. Sa umpisa pa lang nagdududa na ako sa pinagsasabi ng developer so on the next meeting I secretly recorded our conversations. After a series of meetings and recorded conversations which turn sour by the way dahil mukhang pera yung developer.

I'm planning to file a case at HLURB.

Question:

Is the recorded conversation admissible as evidence against the developer?

If the other party concerned did not acknowledged the recording f the conversation, then it will fall under the Anti Wire-Tapping Law. It is not admissible as evidence.

napa-isip ako ng malalim duon sa part na "did not acknowledged". maaari bang malaman sa papaanong paraan? ibig ninyo bang sabihin na sa umpisa pa lang ng paguusap namin ay sinabihan ko na silang recorded ito?

kapag nasa korte na tapos idena-deny nila yung mga paratang ko. so hindi ko magagamit yung secret recordings?

ang sinasabi ni stargazer, ikaw pa ang pedeng sampahan under anti-wiretapping law. nag violate ka ng unconsented private correspondence. and also you violated his constitutional right to private correspondence. you cannot use this against the other party as an evidence as this is not admissible (hindi legally pede).

naisip ko lang itong "recording of conversations" sa kapapanood ng imbestigador. sa case pala ng imbestigador eh hindi rin nila magagamit na ebidensiya yung mga video legally, tama po ba? kaya parang trial by publicity yung nangyayari?

pero kapag may consent ng kabilang party ibig sabihin eh pupuwedeng gamitin bilang ebidensiya?

kung walang consent ng kabilang party, wala pala akong magagamit pangontra sa mga pinagsasabi nung tao sa akin. hmmmm.

ginagamit ang gaya ng sa hawak mong ebidensya sa mga entrapment situations. file a case first. then authority will study the situations. authorized sila sa ganyan for entrapment pusposes. better to file a case first then ask advice sa expert. wag mo muna exposed yang hawak mo. be aware sa counter charge nila sayu sa ginawa mo. may mga conversations na confidentials at ndi mo ito pwdeng ilabas ng wlang consent nung kabilang side. or else ikaw pa makasuhan jan. just kip it for now and you can use it later as ofence once umuusad ang case mo againts them. but sa ngayun. better to ask advice sa mga mas nakaka alam.
