Hi, may house and lot po kami, pansamantalang pinatirhan muna namin sa kamag-anak namin noong kailangan naming lumipat sa probinsya. Napagkasunduan na magbibigay sila ng pera habang ginagamit nila ang bahay kesa umupa sila sa mas malaking halaga sa iba. Pero ngayon, kelangan na namin gamitin ang bahay. Hindi na rin naman sila magbibigay ng pera sa amin pero ayaw nila umalis. Nagbabanta at nananakot pa na foreclosure na raw ang bahay at hindi na raw sa amin yun kundi sa bangko. Wala raw po kaming karapatang paalisin sila. At tutuluyan daw nila ipasara sa mga opisyal ng subdivision. Gusto pa po sana namin ayusin yung mga papeles at bayarin ng house and lot namin kasi po pwede pa po, para magamit namin pero kami pa po ang tinatakot nila. Ano po ba ang pwede naming gawin para mapaalis sila at makabalik po sa bahay namin? Salamat po.

May papers or title ba kayo sa lupa?,

if yes, assuming na hawak nyo yung title, den naka pangalan pa sa inyo. it is impossible na ma foreclose yan, kasi kayo lang yung may LEGAL right na pwedeng maka mortgage/prenda/sangla nyan sa banko.

So what happen yung alleged foreclosure sa banko na hinde kau yung pumirma sa mortgage?, walang effect yun sa inyo. kasi as far as your stand is concern, unenforceable yung contract nila. File kayo ng injunction kung i foreclose ng banko.

If no, or naka title/name yung lupa sa kamaganak nyo, then sorry. wala kayong habol.

The story tells that the lessee is now acting as an unlawful detainees for reason that their ownership didn't exist.

Unless a redemption period in mortgage agreement expires and there is a consolidation of ownership in favor of the mortgagee, the mortgagor/ex-owner has no right over the property. However, the former owner has the priority right to repurchase the foreclosed property. And if that happens, the right of former owner will be restored.

Bali po ang hawak naming papeles ay yung Transfer Certificate of Title (TCT), hinuhulugan po kasi namin dati yun sa SSS. Natransfer na po yung paniningil sa amin ng payment sa Bahay Financial Services (BFS) kasi po foreclosure na po. Bali po kami po yung kinakausap ng BFS regarding sa pagbibigay namin ng remaining balance para po hindi na po ma-foreclose. Ang balak po sana namin (kung maaari) ay magloan para mabayaran yung sinisingil sa amin ng BFS. Hindi rin naman po kasi namin pwede bayaran yung balance kung hindi aalis yung kamag-anak namin at hindi naman po kami yung nakikinabang sa lupa at bahay. May pwede po ba kaming lapitan na makakapagpaalis sa gumagamit ng bahay? Ano po ba ang pwede naming gawin? Salamat po.

have a dialogue with the brgy. if you will not be able to settle it there, ask for a cert to file a case. file a case for unlawful detainer with the mtc where your prop is located so that you'll be restored of the rightful possession of your property if it is still within a year from the time you asked them to vacate your prop, otherwise, your case will now be an action for recovery of ownership (accion reivindicatoria) and is properly cognizable by the rtc of the place where your prop is currently situated
