Hi,

I just wanted to ask a legal advice on a money borrowed from a Lending Company. It was only Php 16,000.00 and it had been 2 years that I kept on paying this amount. For one, I had delayed payments and there were a lot of charges and fees applied by this company. Then they restructured my payment scheme which has cost me more money. After some time, I paid them more than what I owe, can this company file an estafa case if I stop paying them? They claim that I still owe Php 10,000.00. Your help would be much appreciated. Thank you.

You should carefully the fine prints stated in your agreement regarding the loan. It should clearly state there the corresponding interests and penalties (for delayed payments). The company has the right if you have agreed to the agreement when you first borrowed money from them.
