We are retrenced from our company thereby we will be receiving separation pay for the years earned working in this company. But in our quitclaim it is stated that we will be receiving our last pay on three monthly installments starting this july 25 and every month thereafter. Our question is can we ask our company to give us our separation pay in whole this july 25? Is it really in our labor law to give the separation pay in three (3) monthly installments. Please help us regarding this matter. Thank you very much. More power.

Our question is "Is it really in our labor law to give the separation pay in three (3) monthly installments?" Please help us regarding this matter. Thank you very much. More power.

It is in the labor law that retrenched employees will be given a separation pay but it is not clearly stated whether it should be in lumpsum or installment basis

it should be in lump sum, but parties can agree to other arrangements

Good Morning po attyLLL. Thanks so much po sa reply. Can I ask one more question? What if the company insists to give it in three (3) installments, do the employees have rights to ask for lump sum payment? Once again thank you so much. More power to you.
