Sir, I gave my resignation letter last dec 5, its effectivity date is January 9, 2013. I'm wondering is it lawful that my company holds all my salaries since that date?

Our paydates are 5th and 20th. Given my last day is January 9, I expected that I will still get my paycheck on Dec 20, 2012 and January 5, 2013. And that my last pay for payperiod January 1-9 is the pay that will be my "final pay" the one that will be held by the company.

Currently my company is saying that they will combine my dec 20, january 5, and final pay all together as one "Final Pay". Is that lawful? or do I need to file a case in DOLE or NLRC?

got it thanks, however of everyone that I know who resigned in the same company just within the last two months non of them encountered what I am encountering now. It like Im being discriminated against. All my friends who resigned only had their last pays held, all their salaries were released to them while they are still in active duty within the company.
