Hi I'm new here and I want to get some help regarding my resignation.

I resigned last July 5 with an effective date of July 26th. My letter was forwarded by my immediate superior to the HR. On the same day, the HR VP asked me why my effective date is July 26th and I told her that I need to attend to our Family Business right away and this is a much better opportunity for me. The HR VP asked me if the reason of my resignation is due to my immediate superior and I told her no. She asked me if I told anyone that I am resigning and I said yes. She then told me that I shouldn't have said that I am resigning since, according to her, my immediate superior haven't approved it yet. I was surprised and asked her "Ma'am?" then she said that my resignation was forwarded by my immediate superior to her.

They never negotiated an extension for my target effective date until today. My Immediate superior asked if I can extend since my replacements haven't arrived yet.

My question is:

1) Given that the labor code states that at least 30 days notice should be rendered, can I still decline their request for an extension of my resignation effectivity date given the fact that they never negotiated for it when I submitted my resignation last July 5th?

I might come up with follow up questions after this.

BTW, my immediate superior didn't gave me a copy of my resignation letter that she signed.  However, I have a copy signed by the HR Assistant that she received it last July 5th. Given that I don't have a copy my resignation signed by my boss, they are openly talking about it with me and other employees. Can they still deny my resignation and file a case against me if I never come to work after July 26th?

Magandang araw po.
Nagsend po ako ng resignation letter june 16 tapos nilagay ko po hanngang june 30 lang po. ngayun po, nerevise ko para maextend hanggang july 16, para one month. now, hindi na po ako pumasok, hindi ko na po kayang tapusin yung 1 month. one week "absent" na po ako. pero ayoko na po talagang pumasok.
ang tanong ko po is naheheld liable ba ako sa damages, if there is any?
wala pong kontrata sa company na ito. wala ding leave benefits.

u should comply with the 30 days notice period, employer have the right to required you so. if the management let you not comply with the required period make sure that you have a copy of your approved resignation or else there is a possibility that you will be held liable for the damages

Hi vane,

Thanks for the advise. I already did extend it until August 5, 2013 to avoid any problems.
