Arresto Menor

pls enlighten me on this..

a legally married couple adopted a child. the child was registered in the name of the adoptive wife..the husband now wants to change the name of the child and use his (the husband's)name. they were advised to get a lawyer and go to court..

i am confused, is it not that the presumption of the law, if the child is conceived or born during marriage, the child is a legitimate child of the husband? do they need to go through court proceedings or an affidavit will do? thank u.
