30 Days Deduction for not rendering 30 days?

gusto ko lang po sanang
humingi ng payo, tungkol po sa dati kong trabaho, nag immediate resign po ako
sa kanila, hindi po nila binigay yung 2 sweldo ko yung unang cut off po ee 15
days, yung isang cut off po eh 3 days, 22K+ po sana yung matatanggap ko sa final pay
including tax refund & 13th month pay, na pag kakita ko sa final check ko 4K lang po,
dahil daw hindi po ako nag render ng 30 days. idededuct po nila yung 30 days na sweldo ko
na ang kabuuan po ng deductions ay 17K. Dahil daw po sa contract (not notarized, I didn't
sign every pages, sa likod lang po.) ang sweldo ko lang po sa kanila 12,000. Nag conference na
po kame last October 30 2012 sa DOLE makati po, ako po at yung Operation Manager namin yung
nag harap, isinama ko po yung tita ko kase po first job ko ito eh, pero pinaalis niya po. kaya kaming
dalawa lang yung nag harap, sinisingil niya po ako ng 30days sa damages daw
po dahil daw po sa pag training ng kapalit sakin, Junior Agent lang po ako, hindi po
Managerial position ko, tapos inoofferan po ako ng 10,000 daw po para isettle.
Hindi po ako pumayag kase po hindi po ako nanghihingi sa kanila, pinagtrabahuhan ko po yung 22K po na kabuuan ng final pay ko.
May kahihinatnan po ba yung kaso ko? Maraming salamat po.

for not rendering 30 day notice, the company is entitled to damages. if you will not reach a settlement, you will be referred to nlrc and you will have to file position papers if the company will not agree to your 22k. i recommend you consider your options well.
