I am working with this company since 1999. even before I was employed every November the co. is giving us incentive we called "CASHGIFT" to all its employees. Recently, in an informal conversation, the chairman told 1 of the officer, they can opt not to give the said benefit because it is NOT MANDATORY.
Is it legal? isn't it a violation Article 100 of the Labor Code.
Please advise. Thank you!

But its a violation of non-diminution of benefits..write a letter inquiry to management for reasons of deletion.
