Good pm Atty.
I know that the LC provides for 30 days notice in case of resignation. If an ee states in his resignation letter that the effectivity will be immediate. Can the er charge damages? If so, what is the reasonable amount? and how can it be collected especially if the damages exceeds the amount of the ee's last pay?
I hope you can shed light on my query.

It will depend on the reason. On the Labor Code, there are also provisions which allows an employee to terminate his employment without notice.
