Hi, we had an employee for 2 years and in that two years he did not go to work on time... he's manager terminated him with out following the due process (no coaching forms or notice to explain forms were given.) He now filled a case for illegal dismissal.. can anyone please tell me our chances in this particular case as we have a copy of his time sheet since day 1 and i can say that he has been late atleast 90 percent of his stay with us...

Naging maluwag na nga ang kompanya nyo sa late/tardiness..Imagine two years syang late di man lng na memohan..then nung napuno na ang kompanya mo at dinismiss kna nagrereklamo kana..its your professional obligations na hindi dapat malate..one is right, twice is too much,so on ....understand??

Masasami ko lang sa case na ito , it is very clear that the nature of job effectiveness cannot be measure my the time records. I assumed that the employee is performer , because if the company should have seen this issue at the beginning.

The other side of the coin is that the immediate manager of the employee should be responsible to the wrong decisions he/she had taken. It is very clear that there is no due process.
