Hi! My mother put up a down-payment for a house and lot under the name of my elder brother and his wife with the condition that the remaining balance will be paid by them through the developer's in-house financing. Now come the monthly loan payments, my brother is not able to pay them. So me and my wife assumed the loan payments and after several years we are now up to our last few month's payment. However, under the developer's records, the buyer is still my brother and his wife.

My question is: What document do I need my brother and his wife execute so that they are waiving their claim to the property and appoint me and my wife as the rightful owner? I am just afraid that my sister-in-law will not give up the property even though she knows that they have not paid a single centavo on the property.

Thank you for any advise.

a waiver and/or assignment of rights are possible legal options.

due to the complexity of your concern, my advice is that you contact a lawyer who can review all the documents you may have in your possession, especially the contract to sell with the developer, and give you comprehensive advice on the matter including dealing with your sister-in-law.
