Tinubos po ng nanay ko ang lupa ng lolo ko sa father side. Ilang linggo matapos nya matubos ito, hiniram ng kapatid ng tatay ko ang titulo ng lupa. Dahil hindi nakapag-aral ang aking ina, ibinigay nya ito. Makaraan ang ilang taon nabalitaan naming naibenta ito ng kapatid ng aking ama. Ng kausapin namin siya, pinabasa lang nya ang isang deed of sale na dated ng 1997 ngunit hindi kami binigyan ng kopya. Ang lupa ay naibenta daw nya sa halagang P20 per sq. meter bagay na hindi namin pinaniwalaan. Nang magtungo kami sa Registered of Deeds nalaman namin ang nakarehistrong deed of sale sa ay naganap noon 1978 at gamit ang thumbmark na aking lolo na syang may-ari ng lupa. Ang transfer ng titulo ay nangyari lamang noong 1997. Imposibleng naipagbili ng aking lolo ang lupa nung sya ay nabubuhay pa noong 1978 dahil ito ay tinubos ng aking ina noong 1989 lamang. Ang problema namin ay dahil sa ang aking ina ay illiterate hindi sya nakapagtago ng kopya ng cancellation of mortgage at hindi rin nya matandaan ang banko kung saan nya tinubos ang lupa.

Ang tanging hawak lamang namin ngayon ay ang certified true copies ng tax declaration ng lumang titulo (1996) at bagong titulong nakapangalan na sa bagong may-ari (1997) at ang transfer of title dated 1997 at ang deed of sale dated 1978.

Ano pong maaari namin gawin upang makuha ang nararapat ay sa amin. Ayon po sa assessor ang value ng lupa ay P1,000 per sq. meter.

When did your lolo die? your title refers to another deed of sale but there are no details.

Go to the register of deeds and request for a copy of the title still in the name of your lolo. Hopefully, the mortgage is annotated on the title and you will see the name of the bank. You can request the bank to issue a certification as to the fact of mortgage and whether they were in possession of the deed and the inclusive dates.

You have to show that the Deed of Sale was falsified. I would focus on the notarization of the Deed. Go to the Office of the Executive Judge and try to get a copy of the notarial register of the notary. Also check if the notary was really authorized to perform notarial acts in 1978. They might have had it notarized by a lawyer who wasn't even a lawyer in 1978.

I recommend that you initially register an adverse claim on the current title, and then send a demand letter to the owner and your aunt and perhaps they will be willing to pay your mother's rightful share in the property.

if nothing happens, you can choose to initiate a criminal or a civil case (or both) to annul the deed of sale.

thanks for the reply.

My lolo died in 1979 this is probably why my relative dated the deed of sale submitted at the Register of Deeds 1978 but showed us a Deed of Sale dated 1997 with the same details except for the dates and the seller. For the 1997 contract she used her own name as the only surviving heir and seller of the property.

I made an error in saying that we got hold of the deed of sale dated 1978 from the Register of Deeds. We were just fortunate to find someone who provided us with the documents and caution us in dealing with the RD since since my aunt and the buyer probably had a hand inside when fixing the papers.

We tried locating the lawyer by asking around but to no avail. Thanks for the up we'll ask the Office of the Executive Judge if the notary is indeed legal.

Kausapin nyo rin yung buyer na nakalahad dun sa 1997 deed of sale kung papaano ba naibenta ng tita mo yung lupa. Kapag nalaman ng buyer ang totoo, malamang kakasuhan niya ang tita mo ng falsification of public douments o kaya estafa. Depende kung paano hinimok ng tita mo yung buyer para mabili yung lupa.
