when you say you filed a case, do you mean that you filed a complaint with the office of the prosecutor? or was the driver arrested?

I have a car which was parked a few days ago in front of my friend's gate in novaliches, and when my friend went out to get something in my car, nagulat sya at may basag yung head light at gasgas yung bumper, so pumunta sya sakin na nanginginig telling me may basag at gasgas kotse ko, so we both went outside to check it again, nung asa tapat na kami ng kotse, lumapit kapitbahay nila, and sinabi samin na yung isang bahay which is katabi nila ang nakabangga.

So agad pinuntahan ng friend ko yung katabing bahay, babaeng matanda ang lumabas at nagsosorry na nabungo nya, so sabi ng friend ko ang laki laki ng kotse mo hindi mo to napansin? malaki din ang daan para mabangga nya yung car ko. so sabi ng friend ko paayos nya agad yun pero sabi nung matanda di daw pwede di daw available mekaniko nya, so sabi ko nalang na kami nalang papaayos bayaran nalang nya, pero paano yung gasgas sa harap ng bumper kasi halata?
sabi nung matanda sa saturday nalang daw yun anytime pwede.

so pinaayos ko yung headlight at binayaran naman nya, pero ng bumalik ako ng saturday, nagdahilan sya na kesyo nabagsakan sa paa yung mekaniko nya kaya di pwede maayos, so nagalit nako, sabi ko sa kanya hindi ako nakatira dito sa novaliches sa manila pako umuuwi, nandito lang ko sa friend ko kasi sinamahan ko sya na linisan tong bahay, since hindi din dun nakatira yung friend ko kundi sa mom nya na nasa abroad, pinupuntahan lang nya once a month or kung may time sya para icheck yung bahay.

so sabi ko paano yan? nagpaestimate kami sabi ng mga pinuntahan kong mekaniko hindi daw maalis yung gasgas unless pinturahan ang buong bumper eh ang singil sakin is 3k. so sabi ng matanda RUbbing nalang daw mura lang yun.

so ganun na nga ginawa ko pinarub ko worth 200 lang naman pero kita padin yung gasgas, so binalikan ko na naman sya, at nainsulto ako dahil di nya sya lumabas, sabi ng boy nila sa brgy nalang daw,

ininsulto pa nya ko baka pati daw ako bilhin nya, natawa lang ako nung sinabi nya yun, eh 1k nga lang para sa gasgas dimo matanggap tapos ako bibilhin mo pa, matanda na sya ayoko sana sumagot pero hindi maganda ugali nya, hindi ko habol yung pera, ang akin lang eh ipaayos nya agad yun at hindi ako nakatira sa novaliches.

Bukod sa abala gumagastos ako ng pang gas para lang bumalik ng nova galing manila.

ilang araw nako pabalik balik dun, kung tutuusin hindi lang dapat yung bumper pabayaran ko sa kanya kundi yung perwisyo nya sakin at sa trabaho ko. instead na may sahod ako that day, hindi ako nakakapasok para lang puntahan sya.

kasi wala din magawa anak nya ang yabang din kausap kesyo maliit na gasgas daw, at wala pa 1k , eh pina rub ko na nga pero may gasgas padin at may tuklap yung pintura. hindi pwedeng ganun yun kasi kotse ng mommy ko yun, this month uuwi din mom ko, alangan naman kunin ko sa bulsa ko yung pampaayos, buti sana kung kasalanan ko.

kaso hindi eh nangigitgit ako sa galit kasi maayos na nakapark yung kotse tapos aatrasan lang nya, ngayon ayaw nya paayos, dami nyang rason kesyo ganito ganyan. at paano din kung wlang nakakita at di nagsabi tapat namin di hindi ko pa nalaman na sya nakabangga.

Send a demand letter stating what happened and demand the amount required to restore the car to its former condition. End with the statement that if they do not pay within 7 days, you will file a criminal or civil case against them. send it by registered mail with a return card. keep your letter factual and courteous or you may find yourself facing libel.

if they do not pay, you can file a complaint in the small claims court in manila. you will not need a lawyer. it is also not necessary to go to the barangay because you live in different cities.

I would like to inquire regarding my friend who also had a collission with a motorcycle driver with no license. My friend filed a complaint against the driver of the motor vehicle of reckless imprudence resutlting to damage to property. The party of the driver does not want to compromise and filed a counter charge against my friend since he is insinuating that he incurred very slight physical injuries like bruises. Do you think my friend has a lot of chance in winning the case?

one committing a traffic violation at a time of an accident is presumed to be responsible for it. the Supreme court recently ruled that one who drives without a license is presumed to be responsible for the accident. personally, i don't agree with the ruling because I believe it should refer to a moving traffic violation.

I was driving our family fx van when i collided with the vehicle in front of me. This was in a moving traffic where this vehicle suddenly slowed down and i was not able to brake in time. The car i bumped had a few dents while my fx was signficantly damaged.

The vehicle i damaged was a 5 year old toyota innova has comprehensive insurance while my old fx has only TPL.

At the police station, me and the other driver filed depositions and i hv promised the other driver to have his vehicle repaired.

I really don't have funds to immediately pay for the damage.. The other driver insisted on repairs done at toyota repair shop and got a quotation which was very high, for such a minor body damage. I told him the quotation was exorbitant and i cannot agree to it. I sought his consideration for me to look for a repair shop where the quotation will be more reasonable, but will not be immediate.. which he agreed.

A couple of weeks passed.. I was still looking for funds for repair when he proceeded to have his car repaired at toyota without notifying me and then demanding that i now pay the participation fee. I pointed out that he should have sought my consent first, knowing fully well my financial difficulty and disregarded our agreement that i will handle the repairs.

Understanding that the total repair cost that will be demanded from me by the insurance company, i protested... but offered a compromise much as the repair already completed. The other driver refused any compromise and threatened to file a case against me.

May I ask what to expect and given the above circumstances, can I get back at the other driver of disregarding our agreement and proceeded to do the repair himself at the toyota shop? Grateful for your legal advise.. thanks!

well, it seems you allowed weekS to pass without resolving the matter. he can argue that you no longer had any intention to fix the damage.

If all he is asking is for the participation fee, then pay it but have him sign a quitclaim that all your obligations to him have been extinguished. you can then use that as a defense against the insurance company.
