Arresto Menor

A lawyer said that the Prosecution Office made should have not raised the case as attempted homicide because of the medico-legal results (just bruises and healing within a week). If the court decided on the slight physical injury, penalty is 1 month imprisonment? With the "15 days period for the convicted to decide on an appeal or probation", will the convict be sent to jail immediately on the same day of promulgation or he must apply for bail so he will not be sent to jail on that same day to serve his term (while applying for appeal or probation)?
